GoEnhance API Terms of Service

Thank you for choosing GoEnhance! These Terms of Service ("Terms") govern your access to and use of the GoEnhance API services ("API Services", “Services”), provided by MewX LLC (“GoEnhance”, “we”, “our”, or “us”).

By accessing or using the API Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Definitions and Eligibility

1.1 “User” means any individual or entity who registers for or accesses the API Services provided by GoEnhance.

1.2 “Tokens” refer to virtual usage credits purchased by users, which are required to access and consume GoEnhance API Services.

1.3 “Output” means any content generated through the GoEnhance API based on user input, including but not limited to images, videos, animations, or other AI-generated results.

1.4 “Client Application” means any website, client, application, platform, mini-program, or mobile/non-mobile smart terminal legally operated by you that integrates and uses the GoEnhance API Services.

1.5 You must be at least 13 years of age or the minimum age required by law in your jurisdiction. If you are under the age of legal majority, you must have a parent or guardian’s consent.

1.6 “Input” refers to any data, including but not limited to text prompts, images, videos, or other files, submitted by you or your end users to the API Services for processing. You are solely responsible for the legality, accuracy, and compliance of all Input you provide.

2. Account Registration

2.1 To access and use the API Services, you must register an account on the GoEnhance platform using Google login or email address.

2.2 You are solely responsible for maintaining the confidentiality of your account and password, and for any activity that occurs under your account.

3. Purchase and Access to Services

3.1 Access to the API Services requires purchasing tokens, which are usage-based credits.

3.2 Tokens are non-refundable unless required by law.

3.3 You may begin using the API immediately after payment and token confirmation.

3.4 We may revise pricing and terms with notice.

4. License, Output Usage, and Restrictions

4.1 We grant a non-exclusive, revocable, time-limited license to use the API in your Client Applications.

4.2 You may use the Output for both personal and commercial purposes. However, you may not use the Output to train, fine-tune, or otherwise develop AI models intended to improve, replicate, or compete with GoEnhance or similar services.

4.3 Resale or sublicensing of the API/Output as a standalone product is prohibited without explicit permission.

5. Data and Security Responsibilities

5.1 You warrant and represent that all Input, including but not limited to text, images, videos, and files, (a) does not infringe any third-party intellectual property rights, (b) complies with all applicable laws and regulations, and (c) contains no illegal, infringing, harmful, defamatory, harassing, or otherwise objectionable material (including but not limited to hate speech, violent content, or child exploitation material). GoEnhance reserves the right to immediately terminate your access to the Services, withhold any unused Tokens, and pursue legal remedies if your Input violates this warranty. You bear responsibility for the legality, accuracy, and consequences of all Input, regardless of whether such Input was provided by you or your end users through your Client Application.

5.2You are responsible for all actions tied to your API key/token. API keys must not be shared, sold, or transferred to third parties.

5.3 Notify us immediately if your API key is compromised. We are not liable for resulting losses.

7. Intellectual Property

7.1 All rights in GoEnhance software and infrastructure are owned by GoEnhance.

7.2 You retain rights to your Input and can use Output as permitted.

8. Termination

8.1 We may terminate access if you violate terms or pose legal/regulatory risk.

8.2 Termination may void token balance and does not entitle you to refunds.

9. Limitation of Liability

9.1 Services are provided “as is.” We disclaim all warranties.

9.2 We are not liable for indirect or special damages, including lost data or revenue.

9.3 Total liability is limited to the amount paid in the last 6 months.

10. Changes to Terms

We may update these Terms with notice. Continued use indicates acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA. Disputes will be resolved via arbitration.
